This Distance Sales Agreement ("Agreement") is entered into between Alanya Tour ("Seller") and the customer ("Buyer") for the purchase of tours, transfers, and excursion services through our website https://touralanya.com.tr or other remote communication methods.

ARTICLE 1: PARTIES

1.2. BUYER: The person or entity who makes a purchase through our remote sales channels and whose information is collected during the booking process.

ARTICLE 2: SUBJECT OF THE AGREEMENT

2.1. The subject of this Agreement is the determination of the rights and obligations of the parties in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of services ordered by the Buyer from the Seller's website.

2.2. This Agreement covers tour services, transfer services, excursions, and related activities offered through distance selling methods.

ARTICLE 3: SERVICE DETAILS

3.1. The characteristics, price, payment method, and delivery details of the services are specified on our website at the time of booking.

3.2. Services include but are not limited to: day tours and excursions, multi-day tour packages, airport and hotel transfers, private tours and VIP services, activity bookings and tickets, and combined service packages.

3.3. All service details, including itinerary, duration, inclusions, and exclusions, are clearly stated on the service description page and booking confirmation.

ARTICLE 4: PRICE AND PAYMENT

4.1. The prices displayed on the website are final and include all applicable taxes unless otherwise stated.

4.2. Payment Methods: Credit/debit cards (Visa, Mastercard, American Express), bank transfer/wire transfer, cash payment (for local customers, at our office), and online payment platforms (as available).

4.3. Payment Terms: Full payment or deposit (as specified) is required at the time of booking. For multi-day tours, payment plans may be available. Payment confirmation is sent via email upon successful transaction.

4.4. Currency: Prices may be displayed in multiple currencies (EUR, USD, TRY, GBP, RUB). The final charge will be processed in the selected currency. Exchange rates are updated regularly but may vary at the time of actual processing.

ARTICLE 5: RIGHT OF WITHDRAWAL

5.1. In accordance with Article 15 of the Distance Contracts Regulation, services related to accommodation, transportation, car rental, food and beverage supply, and leisure activities performed on a specific date or period are EXEMPT from the right of withdrawal.

5.2. Therefore, the Buyer DOES NOT have the right of withdrawal for tour and excursion services as these are tied to specific dates and times.

5.3. However, cancellation is possible according to our Cancellation Policy: cancellation 48+ hours before service: full refund. Cancellation 24–48 hours before service: 50% refund. Cancellation less than 24 hours before service: no refund.

5.4. The Buyer acknowledges and accepts that booking confirmation constitutes acceptance of this no-withdrawal provision.

ARTICLE 6: DELIVERY AND PERFORMANCE

6.1. Service Delivery: Services are performed on the date, time, and location specified in the booking confirmation. Pick-up location and time details are sent via email and/or SMS. The Buyer must be present at the designated location at the specified time.

6.2. Confirmation: Booking confirmation is sent within 24 hours of payment. Service vouchers or tickets are provided electronically via email. Physical documents can be collected at our office if requested.

6.3. Changes and Modifications: Changes to booking are subject to availability. Modification requests must be made at least 48 hours in advance. Modification fees may apply as stated in our Terms and Conditions.

ARTICLE 7: BUYER'S OBLIGATIONS

7.1. The Buyer agrees to provide accurate and complete information during booking, make payment in full and on time, be present at the designated pick-up location at the specified time, comply with all instructions and safety guidelines provided by tour guides, respect local laws, customs, and other participants, and have valid travel documents.

7.2. The Buyer is responsible for verifying all booking details before confirmation, informing the Seller of any special requirements (dietary, medical, accessibility), ensuring all participants meet age or health requirements for activities, and personal belongings and valuables during tours.

ARTICLE 8: SELLER'S OBLIGATIONS

8.1. The Seller agrees to provide services as described on the website and booking confirmation, send booking confirmation within 24 hours of payment, provide pick-up service at designated locations on time, maintain professional and courteous service standards, ensure safety measures are in place for all activities, and process refunds according to the Cancellation Policy.

8.2. The Seller is responsible for maintaining accurate service descriptions on the website, coordinating with third-party service providers, providing emergency contact information, and handling complaints and disputes professionally.

ARTICLE 9: FORCE MAJEURE

9.1. Neither party shall be liable for failure to perform obligations due to force majeure events including but not limited to natural disasters (earthquakes, floods, storms), pandemic or epidemic situations, war, terrorism, or civil unrest, government restrictions or emergency declarations, strikes or labor disputes, and severe weather conditions affecting safety.

9.2. In case of force majeure: the Seller will notify the Buyer as soon as possible. The Buyer will receive a full refund or the service will be rescheduled to an alternative date without penalty. The Buyer has the right to choose between refund or rescheduling.

ARTICLE 10: LIABILITY AND INSURANCE

10.1. The Seller acts as an intermediary between the Buyer and third-party service providers (hotels, transportation companies, activity operators).

10.2. Limitation of Liability: The Seller's liability is limited to the amount paid for the specific service. The Seller is not liable for acts, errors, or omissions of third-party providers. The Seller is not responsible for personal injuries unless caused by gross negligence. The Seller is not liable for delays or cancellations due to circumstances beyond reasonable control.

10.3. The Seller strongly recommends that the Buyer obtain comprehensive travel insurance covering trip cancellations, medical emergencies, and personal accidents. The Seller is not responsible for costs that would have been covered by insurance.

ARTICLE 11: PERSONAL DATA PROTECTION

11.1. The Seller collects and processes the Buyer's personal data in accordance with the Turkish Personal Data Protection Law (KVKK - Law No. 6698), the General Data Protection Regulation (GDPR), and our Privacy Policy available on our website.

11.2. Personal data collected includes name and contact information (email, phone, address), payment information, booking details and preferences, and communication history.

11.3. Data is used for processing and managing bookings, communicating about services, legal compliance and record-keeping, and marketing (with explicit consent only).

11.4. The Buyer has the right to access, rectify, delete, or restrict processing of personal data. The Buyer can withdraw consent for marketing communications at any time. Data protection requests can be sent to info@touralanya.com.tr

ARTICLE 12: COMPLAINTS AND DISPUTE RESOLUTION

12.1. The Buyer should report any complaints during the service or within 7 days of completion. Complaints can be submitted via email to info@touralanya.com.tr The Seller will investigate and respond within 14 business days.

12.2. For disputes arising from this Agreement, the Buyer may apply to Consumer Arbitration Committees at the place of residence or where the purchase was made, or Consumer Courts at the place of residence or where the purchase was made. Monetary limits for arbitration committees are determined by the Ministry of Trade.

12.3. This Agreement is governed by Turkish law. Disputes shall be subject to the jurisdiction of Turkish courts and Consumer Arbitration Committees.

ARTICLE 13: ENTIRE AGREEMENT

13.1. This Distance Sales Agreement, together with our Terms and Conditions, Privacy Policy, and Cancellation Policy, constitutes the entire agreement between the parties.

13.2. Any amendments to this Agreement must be made in writing and published on our website.

13.3. If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force.

ARTICLE 14: ACCEPTANCE AND CONSENT

14.1. By completing a booking on our website or through our remote sales channels, the Buyer confirms that they have read and understood this Distance Sales Agreement, accepts all terms and conditions stated herein, consents to the processing of personal data as described, acknowledges the absence of withdrawal rights for tour services, and accepts the Cancellation Policy and refund terms.

14.2. The booking confirmation email serves as proof of acceptance of this Agreement.
